Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") is incorporated by reference into the Terms of Use of SynapseCore OÜ ("we," "us," or "our") and governs your use of the SageTalk.ai desktop application and all related services (the "Service").

Your use of the Service constitutes your acceptance of this AUP. It is your responsibility to use the Service in a manner that is legal, ethical, and not harmful to us or any other person or entity.

User's Sole Responsibility for Lawful Use

You are solely and exclusively responsible for your conduct while using the Service and for ensuring that your use complies with all applicable local, state, national, and international laws, regulations, and conventions.

Prohibited Activities

You agree that you will not use, or allow others to use, the Service to engage in any of the following prohibited activities:

  • Unlawful Monitoring, Interception, and Recording: Using the Service to monitor, intercept, or record any audio or visual communication without securing all necessary consents required by law in all relevant jurisdictions. You are solely responsible for complying with all applicable laws, including but not limited to "two-party" or "all-party" consent laws, which may require you to obtain the explicit, informed consent of all participants in a conversation before using the Service.
  • Illegal and Fraudulent Activities: Violating any law, statute, ordinance, or regulation. This includes, but is not limited to, using the Service in furtherance of any fraudulent or other criminal activity.
  • Infringement of Third-Party Rights: Infringing upon or violating the intellectual property rights (including copyrights and trademarks), privacy rights, publicity rights, trade secrets, or any other personal or proprietary rights of any third party.
  • Processing of Highly Sensitive Personal Information: Using the Service to capture, process, or store any "special categories of personal data" as defined under GDPR (e.g., data revealing racial or ethnic origin, political opinions, religious beliefs, health data) or any Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA). The Service is not designed or intended for processing such sensitive information.
  • Security Violations and System Disruption:
    • Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service.
    • Uploading or transmitting invalid data, viruses, worms, or other software agents through the Service.
    • Attempting to reverse engineer, decompile, or otherwise discover the source code of the Application.
    • Using the Service in a way that could impose an unreasonable or disproportionately large load on our infrastructure.
  • Harassment and Objectionable Content: Transmitting or storing any material that is harassing, defamatory, abusive, threatening, obscene, libelous, or otherwise objectionable.

Enforcement

A violation of this AUP constitutes a material breach of our Terms and Conditions. We reserve the right, at our sole discretion, to investigate any suspected violation of this AUP.

If we determine that a violation has occurred, we may take any action we deem appropriate, including, but not limited to, immediately suspending or terminating your account and access to the Service without prior notice. We may also report any suspected illegal activity to law enforcement authorities.

Reporting Violations

If you become aware of any violation of this AUP, you agree to immediately notify us. Please contact us at support@sagetalk.ai with the subject line "AUP Violation."

Modifications to this Policy

We reserve the right to modify this AUP at any time. We will provide notice of any material changes by posting the updated policy on our website and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new AUP.
